Rules of use
The regulatory framework applicable to energy self-consumption is found, mainly, in the following regulatory provisions:
- RD-law 15/2018, of October 5, on urgent measures for the energy transition and consumers;
- RD 244/2019, of April 5, which regulates the administrative, technical and economic conditions of self-consumption of electrical energy;
- RD 1183/2020, of December 29, on access and connection to electric energy transportation and distribution networks; and the
- RD-law 23/2020, of June 23, which approves measures in energy and other areas for economic reactivation.
Additionally, there are other relevant regulatory bodies that, although their purpose is not primarily to regulate energy self-consumption, may eventually have an impact on it. These are: Law 49/1960, of July 21, on horizontal property; the Operating Procedures proposed and approved, respectively, by Red Eléctrica Corporación and the National Markets and Competition Commission; the European Directives and Regulations; regional and local regulations (depending on the location of the project), etc.
With regard to the matrix regulation of energy self-consumption, this is located in the aforementioned Royal Decree 244/2019, which regulates the administrative, technical and economic conditions of the self-consumption of electrical energy, regulates the modalities of self-consumption of electrical energy defined in Article 9 of Law 24/2013, of December 26, on the Electrical Sector.
The provisions of this Royal Decree apply to facilities and subjects covered by any of the modalities of self-consumption of electrical energy defined in article 9 of Law 24/2013, of December 26, on the Electrical Sector.
There are two types of self-consumption, with and without surpluses; within which they can be configured at an individual or collective level. Tornasol markets a product whose use focuses on the “without surplus” modality of the “individual” type, which is characterized by encompassing self-consumption facilities connected to the distribution or transportation network that have an anti-dump system such that it prevents the injection of energy. surplus electricity to the transportation or distribution network; and whose energy consumer is a single owner of a supply point.
Once the legal framework in Spain for solar self-consumption has been verified, and in order to comply with the regulations described above, Tornasol Energy recommends the following:
- The use of a zero discharge device (anti-discharge system) in the event that there is going to be an energy surplus.
- That the connection of the kit to the electrical network is carried out by a qualified professional, who is in charge of completing the necessary documentation if necessary.
- Verify that your electric meter is bidirectional. If not, you can request it free of charge from your electrical distributor. Below we indicate access to the website of each documentation required in each autonomous community.

With the intention of facilitating a quick understanding of the regulations previously described, we summarize below the need or not for permits depending on the type of self-consumption applied by the client:
With Surpluses
Permission Scheme:
- Access and Connection Permit: Production facilities with power equal to or less than 15 kW that are located on urbanized land that has the facilities and services required by urban planning legislation, will be exempt from obtaining access and connection permits. The technician you hire must only request the Self-Consumption Code from the distribution company.
- Prior Administrative and Construction Authorization: Installations with power less than or equal to 100 kW directly connected to a BT network are excluded from the prior administrative and construction authorization regime.

- Have a Technical Design Report (MTD).
- The MTD will be prepared by the hired electrician.
- The minor must understand the content reflected in the ITC-RAT-04 (RD 842/2002, of August 2).
At startup:
- For installations less than 10 kW, you must have an electrical installation certificate, but you will not need an operating authorization.
- The activity license will only be necessary if you are not subject to compensation.
- For installed powers less than or equal to 100 kW, registration in the RAIPRE will not be necessary.
- Environmental Permit: For installations less than 100 kW it depends on the CC.AA. However, in general, installations with power less than 100 kW should not require environmental impact or public utility procedures, except in cases where that the site is under some form of protection.
- Urban Planning Permit: Depends on the CCAA. But most exempt you from obtaining a building permit, replacing this procedure with obtaining a responsible declaration.
- Access Contract: Installations through an internal network of any power and with both BT and AT connections do not need to sign a specific access contract with the distribution company; The access contract that the consumer already has will be valid.
No Surpluses
Permission scheme:
- Access and Connection Permit: Not necessary, you are exempt: Art. 7.1.b).i of RD 244/2019 exempts, regardless of its power, from requesting access and connection permits. In this procedure, the technician you hire must only request the Self-Consumption Code from the distribution company.
- Industry Permit: Not necessary, you are exempt: As long as the power of your kit is equal to or less than 100 kW. You can check this point on page 20 of the self-consumption guide prepared by the IDEA. You are also exempt from registering in the RAIPEE.

When running the installation:
- You will be subject to the ITC-RAT-40; RD 1110/2007 and title IV of RD 244/2019. Which in practice will only mean having a bidirectional meter at the border point (which will coincide with the consumption point).
- If the installation exceeds 25 kW, an inspection (OCA) may be required. It depends on the CCAA.
At startup:
- If the power is less than 10 kW, you only need an electrical installation certificate (CIE), which will replace the certificate of completion of work (CFO).
- It is issued by the hired technician and is presented to the CCAA.
- If the installation exceeds 10 kW, you will need a CFO.
- Environmental Permit: It depends on the CCAA. For example, in the Valencian Community you will not have to process an environmental impact assessment. This is because this type of kits are not included in the Annexes or Law 21/2013, of December 9, on environmental evaluation; nor of Law 6/2014, of July 25, on Prevention, Quality and Environmental Control of Activities in the Valencian Community.
- Urban Planning Permit: It depends on the CCAA. But most exempt you from obtaining a building permit; and replace this procedure with obtaining a responsible declaration. For the Valencian Community we encourage you to take a look at the art. 14.7 and 8 of Decree 14/2020, of August 7.

Regarding safety in the assembly and use of our kits, Tornasol Energy recommends that, as with any other device connected to light, the following safety measures be followed:
- Do not handle your Tornasol Kit with wet hands or barefoot, sneakers with rubber soles and gloves will be enough to guarantee your safety.
- Disconnect your Tornasol Kit from the socket before handling it.
- Keep your Tornasol Kit out of the reach of children.
- Disconnect your Tornasol Kit in case of an electrical storm.
- Remove your Tornasol Kit in case of strong wind or hail, remember that it is the customer's responsibility to ensure the placement of the panels.
Your Tornasol Kit has CE marking and meets the electrical requirements demanded in Spain for self-consumption photovoltaic installations. This is why the microinverter has the EN61000 certification for Electromagnetic Compatibility and EN62109 for Safety of Power Converters in Photovoltaic Power Systems.
In turn, due to their IP68 protection, the panels can withstand rain, wind and a wide spectrum of temperatures without suffering damage. However, in the event of strong winds, we recommend removing the installation for safety.
In the event of a power outage, your Tornasol Kit will turn off automatically, so it does not represent a risk to you or your electrical installation.
Finally, for greater security, you can install a current differential device in your electrical panel, which will provide extra security against power surges or short circuits.
